1. Acceptance of these terms
These Terms of Use ("Terms") are an agreement between you and Jorai ("we", "us"), a journaling app operated by an independent developer based in Ukraine, covering the Jorai iOS application and the jorai.app website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to the Privacy Policy. If you don't agree, please don't use the Service.
The app is licensed, not sold, to you. Apple's standard Licensed Application End User License Agreement also applies to the app as distributed through the App Store; where these Terms are stricter, these Terms apply between you and us. These Terms are between you and us, not with Apple, and Apple is a third-party beneficiary of these Terms entitled to enforce them against you. Apple has no obligation to provide support or to handle any claim relating to the app.
2. What Jorai is — and is not
Jorai is a journaling and self-reflection tool. It transcribes and analyzes your entries, surfaces emotions and patterns, and offers reflective prompts — some generated by artificial intelligence.
- AI can be wrong. Reflections, emotion labels and insights are automated interpretations. They may be inaccurate, incomplete or a poor fit for your situation. Use your own judgment, and treat them as prompts for thought — never as professional advice.
- Voice signals are wellness indicators, not clinical measurements. Emotion, sleep, heart-rate and "pattern" insights are automated estimates and statistical co-occurrences — not facts about your body and not measurements.
- Do not act on AI output for high-stakes decisions. Do not act on any output to take actions that could affect your health, safety, finances, or the safety of others without independently verifying it with a qualified person. Jorai's assistant is purpose-built for reflection on your own journal and is designed to decline off-topic or harmful requests, but these safeguards are not guarantees. You are solely responsible for actions you take based on the Service.
- If something in your life needs medical or psychological attention, please consult a professional.
3. If you are in crisis
Jorai may show supportive resources when an entry suggests distress, but the Service cannot summon help, does not monitor you in real time, and must never be your emergency plan.
4. Eligibility
You must be at least 16 years old to use Jorai. By using the Service you confirm that you meet this requirement.
5. Your account
- Accounts are created with Sign in with Apple. You're responsible for keeping your device and Apple ID secure.
- One account is for one person. Don't share access to your account or use someone else's.
- You can delete your account at any time in the app (Settings → Account → Delete Account); see the Privacy Policy for what this erases.
6. Subscriptions & billing
- Free tier. Core journaling features are free, with fair-use limits (for example, a limited number of reflective follow-ups per entry). We may adjust free-tier limits over time.
- Jorai Pro is an auto-renewing subscription (weekly, monthly or yearly) purchased through the App Store. Current prices are shown in the app before purchase; they may vary by region and are set in your local currency by the App Store.
- Free trial. Where offered (currently 7 days on the yearly plan), the trial converts into a paid subscription unless you cancel at least 24 hours before it ends. Unused trial time is forfeited when you purchase early.
- Renewal & cancellation. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your Apple account settings (Settings → your name → Subscriptions). Deleting the app or your account does not by itself cancel a subscription.
- Refunds are handled by Apple under App Store policies; we cannot issue them directly.
- Changes. We may change subscription prices or what's included in each tier; changes apply from your next billing period, and Apple will notify you where required.
7. Acceptable use
Please don't:
- use the Service for anything unlawful, or to harm yourself or others;
- probe, overload, disrupt or circumvent the Service's security or rate limits;
- attempt to extract, reverse-engineer or misuse the underlying AI systems, prompts or models, or use the Service to build a competing dataset or service;
- access the Service by any means other than the official app and interfaces;
- resell or commercially exploit the Service without our written consent.
We apply automated fair-use limits to keep the Service affordable and available for everyone; intentional abuse may lead to throttling, suspension or termination (section 13).
8. Your content
- It's yours. You own your journal entries and everything you create in Jorai.
- Our license is minimal. You grant us only the limited right to process your content transiently — to transcribe, analyze and generate the reflections you request — and for nothing else. We don't publish it, train models on it, or share it with advertisers (see the Privacy Policy).
- Responsibility. You're responsible for what you write. Journal about whomever and whatever you need to — that's what a journal is for — but don't use Jorai to plan harm.
9. Our intellectual property
The Service — including the app, design, branding, text, illustrations and software — belongs to us or our licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your personal, non-commercial use. The Jorai name and logo may not be used without permission.
10. Changes & availability
- We're a small team improving Jorai continuously; features may change, evolve or be discontinued.
- We aim for reliable service but offer no uptime guarantee. Cloud features may be temporarily unavailable (maintenance, provider outages, force majeure). On-device features keep working offline.
- We may update system requirements (such as supported iOS versions) over time.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied — including fitness for a particular purpose, accuracy of AI-generated content, or uninterrupted availability. Nothing in the Service constitutes medical, psychological, legal or financial advice. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total aggregate liability for any claims relating to the Service is limited to the greater of (a) the amount you paid us through the App Store in the 12 months before the claim, or (b) USD 50.
Nothing in these Terms excludes liability that cannot be excluded by law (for example, for gross negligence or willful misconduct, or your statutory consumer rights).
13. Termination
- By you: stop using the Service and/or delete your account at any time.
- By us: we may suspend or terminate accounts that materially violate these Terms (especially section 7), with notice where practicable. Where required by law, any unused portion of a paid period will be handled per App Store policies.
- Sections that by their nature should survive (8–12, 14, 15) survive termination.
14. Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. If you are a consumer in the EU/EEA, the UK or another jurisdiction with mandatory consumer protections, you keep the protections of your local law, and disputes may be brought in your local courts.
15. General
- Indemnification. To the extent permitted by law, you agree to indemnify and hold us harmless from third-party claims, damages and reasonable costs arising out of your unlawful use of the Service, your breach of these Terms, or your infringement of someone else's rights. This does not apply to the extent a claim results from our own breach, and it does not affect your mandatory consumer rights.
- Severability. If any provision of these Terms is held unenforceable, the rest remain in full effect.
- No waiver. Our not enforcing a right is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them to a successor (for example, in a merger or sale of the app), without reducing your rights.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control — for example outages of Apple, our AI providers or networks, natural events, or war.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
16. Changes to these terms
We may update these Terms as the Service evolves. The date at the top reflects the latest version. For material changes we'll notify you in the app before they take effect; continuing to use the Service after that means you accept the updated Terms.
